Article 4 of the California Constitution states that a marriage may only be contracted in a courtroom, and the person to be married must be legally married.
The person seeking to get married must submit to an oath or affirmation to the court stating that they are the legal parent of their children, that they will abide by all state and federal laws, and that they want to get engaged.
The ceremony must be conducted in the presence of a legal guardian, and any child of the couple must be present.
The ceremony must not be held before a judge or other person not lawfully present.
